On April 7, the INPI (the Brazilian Patent Office) published Rule No. 149/2020, focused on stimulating the production and licensing of new technologies to combat the Covid-19 pandemic.

Under the Rule, the INPI will prioritise examination of patent applications related to pharmaceutical products, methods and devices used for the diagnosis, prophylaxis and treatment of Covid-19. Applicants interested in using this new fast-track route should apply until June 30, 2021.

You can access more details on all available fast-track procedures (in Portuguese) here.

The INPI is also taking a proactive approach to encourage patents for new innovations in combating Covid-19. For example, last week the agency carried out mentoring on the feasability of two patent applications for ventilators, using technology from the Federal and State Universities of Paraíba, respectively.

In March, the INPI had already created a page to monitor technologies related to Covid-19. The goal is to publicize technologies that can contribute to coping with the pandemic, such as vaccines, medications, diagnostic tests, masks and health equipment. Initiatives on financing and the development of research in this area are also being disseminated.
